How to Calculate Rent Increase as per Indian Law

The Rent Control Acts vary by state. Here is a simple guide on how much you can increase rent legally in Maharashtra, Karnataka, Delhi, and Tamil Nadu.

There is no single national formula for rent increase in India. Rent is a "regulated" subject, so each state writes its own rules. In practice, most Indian landlords increase rent by 5-10% every 12 to 24 months, which courts generally treat as reasonable when the increase is modest and regular.

State-by-state at a glance

The rules differ meaningfully depending on where your property is:

  • Delhi (Delhi Rent Act, 1995): If you do not have a written rent agreement, rent increases are limited to 10% every three years. If you have an agreement, the agreed escalation applies.
  • Maharashtra (Rent Control Act, 1999): For old buildings, increases are pegged to a formula. For newer properties, standard escalation clauses in the agreement are honoured.
  • Karnataka (Karnataka Rent Act, 1999): No automatic ceiling — the escalation in your written agreement governs, provided it is not unconscionable.
  • Tamil Nadu (Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017): The act explicitly states landlords and tenants are free to agree on escalation. A common default is a 10% increase every two years.

A practical formula that keeps you legal

The safest approach that works across most states is a written escalation clause in your agreement: a fixed percentage (say 7-10%) applied every 24 months. This gives tenants predictability and gives you a documented, defensible basis for the increase.

  • Give written notice 30-60 days before the increase, and get the tenant to acknowledge it in writing.
  • Put the escalation clause in the original agreement — a mid-term increase without a clause is the most common source of disputes.
